I'm not sure I wholly understand it, but on Twitter, the GiveWP's founder says he will give fees from Marion Millar's canceled crowdfunder (cancelled for "hate"), to a specific UK trans charity.

They must return funds raised to the donors if they cancel the fundraiser. This is illegal as hell.

I think they're saying they'll donate whatever processing fees that they normally pocket, not the money that MM would've gotten. I can't see the twitter link but their statement says:

It was recently brought to our attention that we had one or more customers who promote hate and intolerance. We have since emailed said customers to inform them that their money has been refunded and services terminated.

There have been people suggesting that anyone who donated dispute the charge with their bank in order to get those fees back as well.

Disputing a charge can lead to "chargebacks" for the person/company you paid, and that's not something they generally like. They usually have to pay fees to their bank or credit card processor for them, essentially as a way for them to recover their costs.

It'd be one thing to cancel the crowdfunding campaign. But I'm pretty sure keeping the fees and giving them to a completely different charity (an oppostie charity, no less) is against the law. Someone should file a lawsuit against this.

I think the translation is more like: "we want to please the masses by virtue signalling, because who doesn't like the FREE ADVERTISING(!!!!) that comes from trending on twitter when you hate on women (especially high profile ones). Look at us, aren't we great? Like an retweet so we can go viral and get more users!"

Hi Matt, I would rather you refund everyone's donations direct to them or I will be seeking legal advice, people donated to support me, my legal team haven't received a penny as yet so return. I have taking the difficult decision to put my home on the market and will pay myself.

Nothing in their ToS covers that they get to keep the fees if they cancel your service: https://givewp.com/terms/

However, we reserve the right to refuse our services (our licensing, priority support, and any affiliated services) to any organization at our sole discretion. So people should be able to get their fees back. They also mention the following:

  1. Severability If any part of this agreement is declared unenforceable or invalid, all remaining clauses in this agreement shall remain binding on the customer.

I'm reading this to mean that Marion could actually argue that her funding does not promote hate and so clause #11 is invalid. It might be more of a case after the charges are dropped though. So although not entirely useful to her now, it could help her later.
