NEW YORK - The suspect on parole accused of sucker punching a man in the Bronx that left the victim in a coma was arraigned and released on downgraded charges Thursday night.

It was a move that confused family members of the victim. Friday morning, he was picked up by the state Department of Corrections and taken back into custody after the governor stepped in.

"I took action into my own hands," Gov. Kathy Hochul said. As CBS2's Alice Gainer reports, the family of Jesus Cortes says the 52-year-old remains in the hospital in a coma and needed brain surgery for his injuries. "Can't say days, weeks, months from now, but hopefully he makes better progress day by day," the victim's niece told CBS2's Ali Bauman. "It's been really rough. It's been really rough on all of us." Security video allegedly shows 55-year-old Van Phu Bui put on gloves, then go to another man unprovoked and punch him in the head, causing the victim to fall to the ground.

It happened last Friday around 10:45 p.m. outside the Fuego Tipico restaurant on East 188th Street near the Fordham Road subway station. Cortes suffered a left cheek fracture, skull fracture, abrasions to the knee, a lip laceration and, according to the family, remains in a coma. According to the criminal complaint, Van Phu Bui told a parole officer "I'm in trouble. I hit someone and he's in the hospital. I don't know if he's dead. The police are looking for me. I was at the restaurant and I know the police are looking for me."

He was arrested, and initially facing attempted murder. Based on the evidence they had, the DA downgraded the charges to misdemeanors - assault and harassment - so he was released, without bail.

Van Phu Bui is on parole after serving time for a felony sex crime.

This is only being looked at because the wrong minority did violence to another wrong minority. If this was reversed, a Hispanic man doing the same violence to an Asian man, no one would be up in arms. In New York City it is open season on Asians and Jews as long as you are black or Hispanic. Men are doing most of this violence but women are in on the fun too. NYC has some very fucked up priorities right now. Crime is crime, violence is violence, doesn't matter the victim or the perpetrator.

This is the result of maintaining an oppression league table and the relatively recent dishonest and manipulative redefinition of hate crimes and racism as things that only an oppressor can do to an oppressee. Trans are above criticism because they are in the premier league of oppression. BIPOC (which is just a disingenuous way of saying non-white/non-asian and should be offensive to anyone who's now being lumped into a gigantic amorphous group with their own considerations erased) are above reproach for the same reason. I guess Asians are expected to know better and are expected to meet a higher standard-- that itself should be viewed as incredibly racist and offensive by the people whom that philosophy deems as clearly less civilized. Boggles my mind how anyone can seriously buy into this shit while claiming to be "anti-racist". Well, except it's all part of the same grift.

I don’t doubt the level or frequency of crime in New York. I am responding to the issue that the perpetrator was on parole, seriously harmed someone that may yet die and was not held.

The parolee was on parole due to a prior felony sexual assault.

I don’t care what ethnic background he is or the man that was assaulted. Parolee should have been held.

Yes. This is NYC's m.o. right now if you are a minority you do not.get held for crimes. This article exists because the perpetrator is Asian. If he was Hispanic or black there would be no up roar. I agree that this guy should be locked up, there are plenty of hate crime perpetrators in NYC who are.let go same day no bail regardless of severity of their crime because of their race. This is just a fact. Like it is a fact that this article exists because this man is Asian doing violence to a Hispanic man and not the other way around.
