We have a short window of opportunity for the upcoming meeting of the US Senate Committee on the Judiciary Thursday at 10 AM EST:

Sarah Netburn, a sitting US Magistrate judge, has been nominated to be Judge for the Southern District of New York. She is scheduled to be confirmed in this committee hearing. The agenda is here.

Two weeks ago, Senators Cruz and Kennedy blasted this nominee for recommending the placement of a 6'2" man, William McClain, into a women's prison. He raped a boy, aged 9. and girl, aged 17. In 2016, McClain, now identifying as “July Justine Shelby,” was arrested for the distribution of child pornography, and was sentenced to 15 years at Otisville Federal Correctional Institution. The Bureau of Prisons (BOP) opposed his transfer request out of concern that he would sexually harass female inmates.

Netburn overturned the BOP’s decision, saying it was "based on bias and fear and not evidence.” She dismissed their “concern that Petitioner will hurt someone” as “hypothetical.” Netburn’s conclusion: “The BOP has violated Petitioner’s Eighth Amendment rights by refusing to transfer her to a women’s facility, and that refusal is not reasonably related to legitimate penological interests.”

Netburn initially said McClain was 'soberly and entirely a female'. In her testimony before the Senate Committee on the Judiciary, she clarified that he was 'hormonally female'. Senator Cruz asked if McClain had male genitalia? He did.

This is almost identical to our Chandler vs CDCR case, dismissed by a federal judge, who said our 8th amendment concerns and our fears of rape were unfounded. As you know, Tremaine Carroll, housed in California's Chowchilla Women's facility, is now going to trial for committing two rapes IN the women's facility.

You can send in your comments to the Senate Committee on the Judiciary, but please do so NO LATER THAN WEDNESDAY MORNING.

Let them know you support the Women's Liberation Front, you are a feminist, and you care about women's rights. You can share how you are sickened by WoLF's California case being dismissed, and that the intervenor on our case, Tremaine Carroll, is now facing rape charges, when everyone knows putting men in women's prisons will lead to rape. Express that you oppose the confirmation of Judge Netburn because women have human rights to safe spaces, and men do not belong in women's prisons.
